Le Bénin sur le banc des accusés au Conseil des droits de l’homme de l’ONU

 

Lancement d’un rapport de 18 pages

 

HRWF (27.09.2022) – https://hrwf.eu – Ce mardi 27 septembre, la situation épouvantable des droits de l’homme et l’oppression politique au Bénin ont été soulevées lors de la 51ème session du Conseil des droits de l’homme de l’ONU à Genève, composé de 47 Etats membres, au sein duquel le Bénin siègera jusqu’en 2024.

 

Une déclaration orale co-parrainée par deux ONG, CAP/ Liberté de Conscience (France) et Human Righrs Without Frontiers (HRWF), a exprimé leurs profondes préoccupations quant au recul continu de la démocratie et des droits de l’homme au Bénin depuis l’arrivée au pouvoir du président Patrice Talon en 2016.

 

Le même jour, HRWF a lancé son rapport sur la situation au Bénin dans lequel l’ONG basée à Bruxelles se concentre sur plusieurs sujets particulièrement préoccupants, en particulier la mainmise du président Talon sur toutes les institutions étatiques au profit de son parti.

 

D’autres sujets sont également étudiés par le rapport, tels que

 

– Les arrestations massives de manifestants pacifiques, d’opposants politiques et de chefs de partis en 2021

– La perte d’indépendance du pouvoir judiciaire

– La création d’une cour spéciale pour la poursuite de crimes économiques et de terrorisme (CRIET) instrumentalisée par le Président Talon pour poursuivre ses rivaux politiques sur base d’accusations fabriquées de toutes pièces

– La condamnation de deux candidats à l’élection présidentielle de 2021, Reckya Madougou et Joël Aivo, respectivement à 20 et 10 ans de prison

– Les conditions générales de détention au Bénin, également dénoncées dans le rapport annuel  du Département d’État américain sur les pratiques en matière de droits de l’homme au Bénin en 2021

– L’abus de la détention provisoire et le recours à la torture, déjà dénoncés en 2019 par le Comité des Nations unies contre la torture.

– L’absence de liberté des médias, des journalistes et des blogueurs.

– Les atteintes à la liberté de réunion et les violences policières.

 

Dans leur déclaration orale, les deux ONG ont rappelé qu’en mai 2021, la Commission africaine des droits de l’homme et des peuples a adopté une résolution dans laquelle elle s’est déclarée profondément préoccupée par les restrictions de l’espace civique et la répression des manifestations par l’armée entraînant des pertes de vies, des abus et des violations.

 

Enfin, le rapport de HRWF mentionne également un appel du New York Center for Foreign Policy Affairs aux Etats-Unis, à la fin d’une étude de 73 pages, pour recommander la nomination du Président Talon et de ses associés pour des sanctions dans le cadre du “Global Magnitsky Act.”

 

Dans le même ordre d’idées, HRWF recommande également la nomination du Président Talon et de ses associés pour des sanctions dans le cadre du régime mondial de sanctions des droits de l’homme de l’Union européenne.

Benin in the dock at the UN Human Rights Council

Launch of an 18-page report

 

HRWF (27.09.2022) – https://hrwf.eu – On Tuesday 27 September, the appalling human rights situation and the political oppression in Benin were raised at the 51st session of the UN Human Rights Council in Geneva, composed of 47 member states, in which Benin is occupying a seat until 2024.

 

An oral statement co-sponsored by two NGOs, CAP/ Liberté de Conscience (France) and Human Rights Without Frontiers (HRWF) expressed their deep concerns about the ongoing backsliding of democracy and human rights in Benin since President Patrice Talon came to power in 2016.

 

On the same day, HRWF launched its report about the situation in Benin in which the Brussels-based NGO focused on several topics of particular concern, and primarily the grip of President Talon on all the state institutions to the benefit of his party.

 

Other issues are also investigated by the report, such as

 

  • The massive arrests of peaceful demonstrators, political opponents and party leaders in 2021
  • The loss of independence of the judiciary
  • The creation of a special court for the prosecution of economic crimes and terrorism (CRIET) instrumentalized by President Talon to prosecute political rivals on fabricated charges
  • The sentencing of two candidates of the 2021 presidential election, Reckya Madougou and Joël Aivo, respectively sentenced to 20 and 10 years in prison
  • The general detention conditions in Benin, also denounced in the 2021 of the US State Department on Human Rights Practices in Benin
  • The abuse of pretrial detention and the use of torture, already denounced in 2019 by the UN Committee Against Torture
  • The lack of freedom of the media, journalists and bloggers
  • The breaches of freedom of assembly and police violence

 

In their oral statement, the two NGOs recalled that in May 2021, the African Commission on Human and Peoples’ Rights adopted a Resolution in which it declared to be deeply concerned by the restrictions on civic space and the crackdown on demonstrations by the army resulting in loss of lives, abuses and violations.

 

Last but not least, HRWF report also mentions a call of the New York Center for Foreign Policy Affairs to the US at the end of a 73-page study to recommend the nomination of President Talon and his supporting associates for sanctions under the Global Magnitsky Act.

 

On the same lines, HRWF also recommends the nomination of President Talon and his associates for sanctions under the EU Global Human Rights Sanctions Regime.

Mocevic Case: Oral statement at the 47th UN Human Rights Council Session

Submission by the “Coordination des Associations et des Particuliers pour la Liberté de Conscience” (CAP-LC) for the oral statement limited to 1’30” 

CAP Liberté de Conscience (21.06.2021) – Mr. Dalibor Močević, a Croatian and Bosnian national of Serbian descent, is a victim of human rights violations in Croatia. Following the prohibition of discrimination based on race, sex, language and religion in the Charter of the United Nations, the adoption of the Universal Declaration of Human Rights became the next important step in the legal consolidation of the principle of equality before the law and the resultant prohibition of discrimination.

 

Being continually discriminated against by Croatian authorities because of his national and ethnic origin, Mr Močević was deprived of property belonging to his ancestors, his apartment in Zadar and passenger ship business, he had to abandon due to the discriminatory pressure from Croatian tax authorities and even the parental rights of children he has with ethnic Croat mothers.

 

Many troubles Mr. Močević and his family were faced with, stemmed from ethnically motivated discrimination and hatred that is widespread among the population and political parties that base their ideas on nationalism and xenophobia, especially towards the Serbs. Such treatment is especially evident in the region of Dalmatia and other places which are particularly Catholic, and where the population is of lower education and wealth.
